For Job Seekers:
- Seekerspot can act as a processor for your application materials that are submitted through Seekerspot Apply and for the interview information when you participate in an interview on Seekerspot, depending on the processing requirements. The Employer to whom you are applying controls this data. As a processor, Seekerspo holds onto the data until the controller requests it to be deleted.
- All other information that you provide while using our Sites is controlled by Seekerspot.
For Employers:
- Seekerspot can act as a processor for Job Seeker applications that are submitted through Seekerspot Apply, and for the data that you provide to Seekerspot via Candidate Import, depending on the type of processing required. If you sign up for our Candidate Import service, you will need to consent to a DPA with Seekerspot that outlines the terms of our relationship. As a processor, Seekerspot holds onto the data until the controller requests it to be deleted.
- All other information that you provide during your use of our Sites is controlled by Seekerspot.
The Seekerspot entity that is responsible for controlling your information may vary depending on your location and the particular product or service you are using on our platform. Please be aware that the entity specified in our Terms of Service for contractual purposes may not be the same entity that acts as the controller as outlined in this Privacy Policy.
Scope of Seekerspot’s Privacy Policy
This Privacy Policy pertains to the data that we gather through the Sites, either directly from individuals or from third parties. If you click on a link that leads to a third-party website, you will no longer be subject to our Privacy Policy, and any data collection or processing that occurs on that website will be governed by the website’s own privacy policy. We also use Communication data to send Job Seeker’s relevant Job Listings and applications to Employers, as well as marketing emails. Our legitimate interests in providing a valid and relevant service to our users and improving our products and services form the legal basis for processing this data.We provide an opt-out option for marketing messages. In the limited cases where we record calls, we rely on your consent. The retention period for communication data is the lifetime of the account.
- Contact Information: We collect, process, and store your contact information, including your name, phone number, email, and address. This data is used for various purposes. - Messaging Data: We collect and process messages sent by users on the Sites, ATS connected with Seekerspot’s service, and through Seekerspot’s messaging Relay Service. The company monitors, reviews, stores, and analyzes such content, including through automated means, for data analysis, quality control, enforcement of the Sites’ rules and policies, content moderation, and to improve the Sites or any other Seekerspot product or service.These improvements may include optimizing message delivery, improving search results and Job Listings, allowing applicants to manage their applications, providing Job Seekers with the status of their applications, ensuring personalized product features and communications, and preventing fraud and spam. Seekerspot relies on its legitimate interest in keeping the Sites safe and secure to process this data.Messaging data is monitored to prevent malicious, spam, or fraudulent activity as part of the performance of a contract. Depending on the applicable law, Seekerspot may also rely on the user’s consent. The retention period for this data is 10 years.
- Payment Information: When you use Seekerspot’s chargeable services, such as sponsored job postings, we collect the last four digits of your payment card and other verification data to facilitate payment and verify your account.Seekerspot never stores your full card number to ensure the security of your payment information. Additionally, we may use this information to comply with our legal obligations regarding financial reporting and valid legal information requests.It is in our legitimate interest to ensure we are in contact with the correct person for the purposes of providing our services. The retention period for this information is determined by applicable legal requirements.
- Scheduling Information: Seekerspot collects, processes, and stores your availability and responses to calendar invitations for interviews, including from third-party calendar providers if you choose to link them to your account.The purpose of collecting this information is to facilitate interviews scheduled through and held on Seekerspot’s interview platform. This information is collected as part of the performance of a contract so that Job Seekers are able to interview with Employers.The retention period for this information is account lifetime.
- Telephone Data: When a job seeker or employer is contacted through Seekerspot’s telephone Relay Service, Seekerspot collects, processes, and stores information about whether the call was answered and the call duration. However, the company does not record calls made through the Relay System.The purpose of processing this information is to facilitate contact between job seekers and employers for the purpose of submitting applications, conducting job interviews, or other communication related to a job listing. Seekerspot’s legal basis for facilitating this contact is the performance of a contract while processing information on whether a call was answered pursuant to their legitimate interest in providing their services.Depending on the applicable law, Seekerspot may rely on the user’s consent. The retention period for this information is for the account lifetime.
- Authentication Data: When logging into your Seekerspot account using Single Sign-On (SSO), we collect certain information such as your name, profile picture, public profile information, and email address. We use this information to authenticate you as a user of both Seekerspot and the third-party platform you used for SSO.This helps make the sign-in process more convenient and secure for you. - Demographic Data: We may collect and process special category data, such as age, race & ethnicity, gender, disability, arrest or conviction history, and LGBTQ+ community membership, under limited circumstances and only in markets where it is permitted by law. - Disposition Data: We collect, store, process, and analyze information about the status of your job application and the decisions made by you or the Employer, such as whether you were contacted, interviewed, hired, or if you withdrew your application or rejected an offer.We process this information to gain a better understanding of the effectiveness of our Sites and their features. Our legal basis for collecting and processing this information is our legitimate interest in operating, managing, and improving our Sites.We retain this data for the lifetime of your account.
- Profile Data: We collect and process various data included in your Profile, such as your resume, photo (where applicable), preferences, qualifications, and assessment information, and when you are online or recently active on Seekerspot.We store, process, and analyze this information to provide you with more relevant Job Listings, send you invitations to apply to certain jobs, and offer suggestions when you apply for jobs on third-party websites in our mobile software. - Searchable Resume Data: When creating a resume on Seekerspot, you are given the option to make it searchable or not. If you decide to keep your resume searchable, potential Employers will be able to find and view your resume, and a publicly-viewable URL will be generated. Your searchable resume data will include information such as your work and education history, certifications, licenses, patents, and other data you provide.This option may also allow Employers to see that you have expressed interest in jobs similar to their job listings. We will collect, store, process, profile, and analyze your searchable resume data to enable Employers to invite you to apply for their jobs. The legal basis for this is the performance of a contract, as the data is essential to help you find jobs.Seekerspot relies on its legitimate interest for analytical purposes in providing a valuable and relevant service to Employers. You can change the visibility of your resume at any time, and the retention period for your searchable resume data is the lifetime of your account or until you remove your resume.
- Non-Searchable Resume Data: If you choose to make your resume not searchable on Seekerspot, only you and any third parties that you give permission to can view it. We will collect, store, process, profile, and analyze your not searchable resume data but will only share it with Employers when you apply for jobs.The legal basis for processing your data is the performance of a contract, as these data are essential to help you find jobs. The platform also relies on its legitimate interest for analytical purposes in providing a valuable and relevant service to the Job Seeker.The retention period for your not searchable resume data is the lifetime of your account or until you remove your resume. Personal Data We Collect from the Employers:
- Business Information: When registering a business on a Seekerspot, you may be required to provide verification documentation about your business, including employee contact details and the business’s physical location. This documentation could include a Federal Employer Identification Number (EIN), Business Registration information, a utility bill, and employer screening information. We collect, process, store, and analyze this data for internal purposes only, subject to any request by law enforcement or court order, to verify that Employers on the site are legitimate.Seekerspot processes this data to prevent fraud and spam and protect Job Seekers, enhance its service, and improve the accuracy of market analysis and sales strategy. The legal basis for processing this data is the platform’s legitimate interest in detecting and preventing fraudulent activities on its sites, enhancing its service, and improving the accuracy of market analysis and sales strategy, and where required to comply with a legal obligation.The retention period for verification data is until the account has been verified, and for billing information, the platform retains it in line with legal requirements.
- Rich Media Content: Seekerspot allows Employers to upload videos, pictures, and other content about their business, which can be imported and/or stored and displayed on the site. This content can enhance Job Listings and Company Pages by adding rich media content.The legal basis for processing this data is consent, as an Employer does not have to provide this data. We also have a legitimate interest in improving our services and helping Employers attract the best quality candidates.The retention period for this content is the lifetime of the account or until it is removed by the Employer.
- Video Recordings: Seekerspot may allow users to conduct and participate in pre-recorded and live interviews on the Seekerspot Hiring Platform. In this case, the platform acts as a data processor, processing video recordings on behalf of Employers until instructed to delete the data.The legal basis for processing this data is the performance of a contract, as the platform processes these videos on behalf of an Employer and deletes them at the Employer’s request.The retention period for these videos is until instructed to delete by the Employer, in line with the platform’s role as a data processor.
Other Purposes and Disclosures of Information
- Resume Data: When you create a resume on Seekerspot, it will be set to searchable by default. This means that your resume data, except as otherwise indicated, may be available to third parties like Employers. By making your resume searchable or uploading a file resume on the Site, you are requesting and authorizing Seekerspot to make your resume available to third parties in accordance with the Site’s Terms.However, Employers and Employer representatives who access your resume data while it is set to searchable visibility or to whom you apply with your not searchable resume may choose to share your resume with additional parties. Please note that Seekerspot is not responsible for such sharing. In addition, if you share your searchable resume directly with a personalized link, Seekerspot cannot control who sees your resume.If you do not want Employers to contact you or if you do not want Seekerspot to make your resume data available to third parties without your direction, you can set your resume to not searchable. You may change your resume privacy settings at any time. - Employer Accounts: As a part of our services, we allow users to link their Employer accounts, and assign specific roles that determine the level of access to candidate Personal Data within the parent account. By inviting other users to link their accounts to yours, you consent to share all the information in your account with the linked users.This includes candidate Personal Data such as resume contacts, application materials, statuses, communications with applicants, action history, and billing information. If an Employer account is delinked, whether by your own choice or by an administrator’s decision, access to all candidate Personal Data in the linked account will be lost.
- Resume Review Services: Within our service offerings, we provide the option for users to connect their employer accounts and grant designated roles that determine the extent of access to candidate Personal Data under the parent account. By inviting other users to link their accounts to yours, you agree to share all information within your account with the linked users.This encompasses candidate Personal Data such as application materials, contact information, communication history with applicants, action history, and billing details. In the event that an employer account is delinked, whether voluntarily or by an administrator’s decision, access to all candidate Personal Data in the linked account will be forfeited.
- Automated Handling of Your Personal Data: We utilize automated handling of Personal Data for the purpose of evaluating specific aspects related to a user and analyzing and predicting their preferences and interests. This processing is carried out based on either the user’s consent or the performance of a contract, which is necessary for us to offer our services to Job Seekers and Employers.This type of processing enables us to effectively match Job Seekers with suitable Employers, provide Job Alerts and recommended job opportunities, invite Job Seekers to take action on relevant jobs, send specific Job Seeker applications to Employers, display search results, send application status notifications on behalf of Employers, and conduct spam and fraud detection activities to ensure the protection of our users.Our privacy policy outlines the measures we have in place to safeguard our users’ privacy in the context of processing. Sharing of Data With Job Seekers
Seekerspot provides Job Seekers with certain information related to Employers to help them make informed decisions about employment opportunities. This can include publishing Job Ads, Company Pages, and salary information on our Sites, as well as making available certain Employer-related information, such as an Employer’s activity and responsiveness on the Sites.This information may include details such as the Employer representative’s name, location, and whether the Employer has taken any action with respect to the Job Seeker’s resume or application, such as opening, viewing, or responding to it. We also publish Job Listings on third-party websites to increase their visibility and reach.
